Terms and Conditions for Services

Welcome to Active Art Studio! By booking our services, you agree to the following terms and conditions. Please read them carefully to understand your rights and obligations.

2. Booking and Payment

2.1 Reservations: All bookings are confirmed once a deposit is received. *$20 deposit is required for booking.
2.2 Payment: The remaining balance is due on the day of the event, prior to the start of the face painting service, unless otherwise agreed upon.
2.3 Accepted Payment Methods: We accept cash, and electronic transfers (Zelle/CashApp)
2.4 Cancellations and Refunds: Cancellations must be made at least 48 hours in advance for refund of the deposit. Cancellations made less than 48 hours before the event will result in forfeiture of the deposit.

3. Service Guidelines

3.1 Safety and Hygiene: We use only professional, FDA-approved, hypoallergenic face paints and materials. Brushes and sponges are cleaned and sanitized after each use.
3.2 Allergies and Skin Conditions: It is the responsibility of the client to inform the artist of any allergies, skin sensitivities, or conditions before the face painting begins. We reserve the right to refuse service to anyone with visible skin infections, open wounds, or contagious conditions.
3.3 Age Restrictions: Face painting services are available for children ages 3 and up. We may refuse to paint on infants or toddlers under the age of 3 for safety reasons.
3.4 Design Requests: While we strive to accommodate all design requests, some may not be feasible due to time constraints, complexity, or suitability. The artist reserves the right to modify designs as needed.
3.5 Outdoor Events: For outdoor events, the client must provide a shaded or covered area to protect the artist and materials from direct sunlight, rain, or extreme weather conditions.

4. Liability and Indemnity

4.1 Limitations of Liability: Active Art Studio Llc is not responsible for any allergic reactions, skin irritations, or damages resulting from the use of face paint. It is the client's responsibility to ensure participants do not have any known allergies or sensitivities to face paint.
4.2 Damage to Property: The client agrees to provide a clean and safe environment for the face painting setup. Active Art Studio Llc is not responsible for any damage to property caused by participants or guests.
4.3 Supervision of Minors: Children must be supervised by an adult at all times during the face painting session. Active Art Studio Llc is not responsible for the behavior of children or accidents that may occur during the event.

5. Photography and Media Release

5.1 Consent: By booking our services, you consent to the taking of photographs during the event, which may be used for promotional purposes on our website and social media channels. If you do not wish to have photographs taken, please inform us in advance.
5.2 Privacy: We respect your privacy and will not disclose any personal information without your consent.

6. Changes and Cancellations by Active Art Studio

6.1 Unforeseen Circumstances: We reserve the right to cancel or reschedule bookings due to unforeseen circumstances, such as illness, emergencies, or inclement weather. In such cases, you will receive a full refund or the option to reschedule.
6.2 Substitute Artists: If the scheduled artist is unable to attend due to unforeseen circumstances, we will arrange for a qualified substitute artist or offer a full refund.

7. Governing Law

These terms and conditions are governed by the laws of the state or region in which the service is provided. Any disputes arising from the use of our services will be subject to the jurisdiction of the local courts.

Refund and Cancellation Policy for Events

1. Cancellation Policy

1.1 Advance Notice: Cancellations must be made at least 48 hours before the scheduled event to receive a full refund. Deposit paid isn't refund.
1.2 Late Cancellations: If you cancel less than 48 hours before the event, the deposit will be non-refundable. However, you may reschedule the event within 30 days, subject to availability, without losing your deposit.
1.3 No-Shows: If you fail to notify us of a cancellation and do not show up for the event, no refunds or rescheduling will be offered.

2. Rescheduling Policy

2.1 Rescheduling Requests: Requests to reschedule must be made at least 24 hours before the event. We will do our best to accommodate your new date, subject to availability.
2.2 Weather-Related Changes: If your event is outdoors and needs to be rescheduled due to inclement weather, please notify us as soon as possible. We will work with you to find a suitable new date.

3. Refund Policy

3.1 Full Refunds: Full refunds will be issued if we are unable to provide the services due to unforeseen circumstances on our end, such as artist illness or emergencies.
3.2 Partial Refunds: If the event is interrupted or shortened due to factors beyond our control (e.g., weather, venue issues), we may offer a partial refund based on the remaining service time.
3.3 Payment Method: Refunds will be processed using the original payment method within 5-7 business days.

4. Deposits

4.1 Non-Refundable Deposits: For certain bookings, a non-refundable deposit may be required to secure your date. This will be clearly communicated at the time of booking.
4.2 Deposit Transfers: In case of rescheduling (with proper notice), your deposit can be transferred to the new date within a 30-day period.

5. Exceptions

5.1 Force Majeure: No refunds will be provided for cancellations due to natural disasters, acts of war, government regulations, pandemics, or other circumstances beyond our control.
5.2 Health and Safety: If any participant is visibly ill or showing signs of contagious conditions, our artists reserve the right to refuse service to ensure the safety of all guests. No refunds will be issued in such cases.
